A person has the right to take off for the regularly scheduled appointments necessary throughout pregnancy, as well as for a more lengthy maternity leave. Failure to provide this time off or terminating an employee for trying to take this time off is pregnancy discrimination, for which employers can be held accountable. Similarly, failing to provide the same position or a position at the same level to a person returning from pregnancy leave may also constitute discrimination.
Employers Never Acknowledge Pregnancy Discrimination
We have seen the scenario play out many times. An employee will tell their employer about the pregnancy, setting the stage for the time that will need to be taken off. Later, the pregnant employee is the victim of wrongful termination. Of course, the employer will mask the termination as a performance issue or something along those lines, although it is clear that the company is terminating the employee because of the pregnancy.
